These Terms and Conditions ("Terms") govern your access to and use of truesourcewellness.com and any products, content, features, accounts, and services made available by True Source Wellness LLC (collectively, the "Services"). By accessing the website, creating an account, completing a consent form, or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Services or purchase products. By using the Services, you represent that you meet these requirements and that the information you provide is accurate, current, and complete.

2. Health and Product Information

Content provided through the Services is for general informational purposes only. It is not medical advice and is not a substitute for advice, diagnosis, or treatment from a licensed healthcare professional who knows your medical history. Do not disregard professional medical advice or delay seeking it because of something on the website. If you believe you are experiencing a medical emergency, call 911 or seek immediate medical care.

Read all product labels, warnings, instructions, ingredient information, and required consent materials before use. Consult a qualified healthcare professional before using a product if you are pregnant or nursing, have a medical condition, take medication, have allergies, or have questions about whether a product is appropriate for you. Individual results vary, and no particular outcome is promised. Product statements are subject to applicable regulatory requirements and, when stated on a product or its page, may not have been evaluated by the U.S. Food and Drug Administration.

3. Required Consent Form

Each order requires completion of the consent form presented at checkout. You must review the form, provide truthful and complete information, initial required acknowledgments, and apply your electronic signature. By electronically signing, you intend your signature and initials to have the same legal effect as handwritten ones. We may refuse, pause, or cancel an order if the form is incomplete, appears inaccurate, is not signed by the purchaser, or does not satisfy our requirements.

We may update a consent form when our products, procedures, or legal obligations change. An updated form may require a new signature before checkout. Consent forms and related audit records are retained as described in the Privacy Policy, including when other data is deleted, when retention is reasonably necessary or legally permitted.

4. Accounts and Security

You are responsible for safeguarding your login credentials and for activity under your account. Do not share an account or impersonate another person. Notify us promptly at support@truesourcewellness.com if you suspect unauthorized access. We may suspend or terminate an account to protect users, the business, or the Services.

5. Orders and Acceptance

Your order is an offer to purchase. We may accept or reject an order in our discretion, including because of product availability, pricing or description errors, payment issues, suspected fraud, incomplete consent materials, shipping restrictions, or legal requirements. An automated confirmation only acknowledges receipt; acceptance occurs when we confirm shipment or otherwise expressly accept the order. If we cancel after payment, we will refund the amount charged for the canceled item or order.

We may limit quantities, refuse resale orders, or restrict purchases by person, household, account, payment method, or address. Products may not be purchased, exported, resold, or used in violation of law.

6. Prices, Payment, and Taxes

Prices, promotions, product availability, and descriptions may change without notice before an order is accepted. You authorize us and our payment processor to charge the payment method you provide for the order total, including applicable taxes and shipping charges. You are responsible for all charges and for providing accurate billing information. We may correct errors and cancel an affected order, even after submission, subject to applicable law.

7. Shipping, Delivery, and Risk of Loss

Shipping and delivery dates are estimates, not guarantees. Delays may occur outside our control. You are responsible for providing a complete, accurate, and deliverable address and for following any delivery, storage, inspection, or temperature instructions supplied with a product. Title and risk of loss transfer as provided by applicable law and the shipping terms shown at checkout.

8. Returns, Refunds, and Cancellations

Returns, refunds, exchanges, and cancellations are governed by the policy displayed on the website and at checkout when you place your order. Certain wellness, personal-use, consumable, opened, used, temperature-sensitive, customized, or final-sale products may be ineligible for return when disclosed before purchase and permitted by law. Nothing in these Terms limits rights that cannot legally be waived.

9. Transactional Communications

You agree that we may send service-related emails and, if you provide the required consent, transactional text messages concerning your orders, account, payments, consent forms, shipping, security, or support. We do not use the transactional SMS program for marketing. SMS terms, including opt-out instructions, are stated in the Privacy Policy.

10. Acceptable Use

You may not:

• Use the Services for unlawful, fraudulent, deceptive, harmful, or abusive purposes.
• Provide false information, forge a signature, complete a consent form for another adult without lawful authority, or evade purchase restrictions.
• Interfere with security, probe vulnerabilities, introduce malicious code, scrape the Services without permission, or attempt unauthorized access.
• Copy, modify, distribute, sell, sublicense, reverse engineer, or exploit the Services or content except as allowed by law or written permission.
• Infringe intellectual property, privacy, publicity, or other rights.
• Use products contrary to their labels, instructions, intended use, or applicable law, or resell products without written authorization.

11. Intellectual Property

The Services and their content, design, text, graphics, logos, product names, software, and other materials are owned by or licensed to True Source Wellness LLC and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, nonexclusive, nontransferable license to use the Services for your personal, lawful use. No other rights are granted.

12. Third-Party Services and Links

The Services may rely on or link to third-party services, including payment, shipping, and communications providers. We do not control third-party websites or their independent terms and practices. A link does not imply endorsement.

13. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND WEBSITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TRUE SOURCE WELLNESS LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT INFORMATION WILL BE COMPLETE OR ACCURATE. PRODUCT WARRANTIES, IF ANY, ARE LIMITED TO THOSE EXPRESSLY PROVIDED WITH THE PRODUCT OR REQUIRED BY LAW.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRUE SOURCE WELLNESS LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR A CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TRUE SOURCE WELLNESS LLC FOR THE PRODUCT OR TRANSACTION GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE EVENT OR (B) ONE HUNDRED U.S. DOLLARS. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED BY LAW.

15. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless True Source Wellness LLC and its members, managers, employees, and agents from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys’ fees arising from your unlawful or unauthorized use of the Services, your breach of these Terms, your violation of another person’s rights, or information you submit. This obligation does not apply to the extent a claim results from our own unlawful conduct.

16. Suspension and Termination

We may suspend or terminate access, cancel an order, or take protective action if we reasonably believe you violated these Terms, created risk or legal exposure, engaged in fraud or abuse, or threatened the security or integrity of the Services. Provisions that by their nature should survive will survive termination, including payment obligations, intellectual property, disclaimers, liability limits, indemnification, governing law, and dispute provisions.

17. Governing Law and Venue

These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles. Any legal action arising from these Terms or the Services must be brought in the state or federal courts serving Aurora, Colorado, or otherwise having proper jurisdiction over True Source Wellness LLC’s principal office, unless applicable consumer law requires otherwise. You and True Source Wellness LLC consent to the jurisdiction of those courts.

18. Changes to These Terms

We may update these Terms from time to time. The revised Terms become effective when posted unless a later date is stated. Changes will not apply retroactively where prohibited by law. Your continued use after the effective date means you accept the revised Terms. Material changes will receive additional notice when required by law.

19. General Terms

These Terms and the policies incorporated by reference are the entire agreement between you and True Source Wellness LLC concerning the Services. If a provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations without our written consent; we may assign ours in connection with a business transaction or by operation of law. Headings are for convenience only.
